Net thirty (30) days: over thirty days, subject to finance charge. Visa, Master-Card and American Express are accepted.

Return Policy
Niagara Caps & Plugs will not accept any returns without prior authorization. Returns of standard cartons within 30 days are subject to a 30 percent restocking fee and from 30 to 90 days, 50 percent. No returns after 90 days.The customer is also responsible for freight charges. Red-E-Paks, Micro-Paks and non-standard colors are not returnable.

Important: To help minimize ordering wrong parts, Niagara Caps & Plugs highly encourages you to request FREE SAMPLES of your desired part before placing an order with us.

Cancellation
Pricing is quoted based on the quantity indicated, and if such order is cancelled short of the quoted quantity and time period, the customer will be liable for cancellation charges. In the event of cancellation involving non-standard materials, colors and/or tooling, the purchaser assumes all responsibility and may be asked for immediate payment.

Claims
All claims for shortages or defective material must be made within thirty (30) days from date of invoice. Parts proving defective will be replaced or credited, but no claims for labor or damages will be allowed without our written consent.

Packaging
Niagara reserves the right to change the quantities in its standard carton or Red-E-Pak consistent with current packaging and/or shipping practices.

Contract
All contracts are subject to approval by an officer of Niagara Caps & Plugs. All contracts are made contingent upon strikes, fires, accidents, clerical errors or other causes beyond our control.

Credit
Unpaid invoice amounts shall constitute a lien on any merchandise ordered by customers but not yet shipped.

Uses
The uses to which Niagara Caps & Plugs products are put are solely within the discretion and responsibility of the purchaser and/or user. Purchaser of standard and custom parts assumes any and all liability arising out of, or in any way connected with, the use of such standard or custom parts and hereby agrees to indemnify Niagara Caps & Plugs for such liability.

Product Warranty
Niagara product is guaranteed to be free from defective material or workmanship for a period of ninety (90) days from the date of shipment, and this warranty shall be limited to the replacement of any defective product. Any part proving to be defective upon inspection at Niagara's factory Cresson, PA, will be replaced. No allowance, credits or reimbursements will be made for any returned products unless authorized by Niagara Caps & Plugs Company. All returns must be accompanied with a Return Authorization number.

There are no warranties either expressed or implied which extend beyond the description above, including the implied warranty of merchantability and fitness for a particular purpose.

Any sale and purchase shall be subject to all rights and duties of seller and buyer under the provisions of the Uniform Commercial Code - Sale of the Commonwealth of Pennsylvania.

Quantities
Orders for Non-Standard colors or materials are considered complete with a ±10% deviation.

Specifications
Standard catalog items are quoted in accordance with Niagara Caps & Plugs print. If customer's print deviates from Niagara's in any form, customer's print will be considered null and void.

Custom parts will be furnished in accordance with buyer's print and/or specifications.

Tooling
Customer-owned tooling shipped to Niagara or manufactured by Niagara will receive normal maintenance during the life of the tool which is defined as one million parts per cavity. After that, the customer is responsible for any major tool rebuilds. Any customer-owned tooling not used for production of parts for a period of two years will be deemed abandoned after a 30-day written notification.
